Drudge Should Have Finished This

Here’s Drudge’s headline about the Kagan hearings:

Like I said, he should have finished it, but then again, I digress….

Monday. Ugh.

Filed under: | Axis of Donks | SCOTUS and The Law

This is one Monday morning where I don’t feel like going in to work. But I have to; at least I have next Monday off, as we observe Independence Day (more on that later). Here’s what’s on the wires:

BYRD DEAD: I was actually up when news broke of the death of the senior Senator from WV. That means goodbye, Federal Pork!

5-4 ON GUN RIGHTS: Kennedy joins the conservatives in ruling the 2nd Amendment also applies to states and localities.

KRUGMAN MOUTHS JOE THE BIDEN™: Says the same thing the Vice President did a few days ago. Ugh.

Оба́ма Nominates Каган

Filed under: | Axis of Donks | SCOTUS and The Law

Her name was in the hopper the last time around, and finally, Президент Оба́ма has put forth Елена Каган to succeed retiring Associate Justice John Paul Stevens.
Everything else aside…and I mean, everything…Каган is the current Solicitor General of the United States. While she has legal experience, it hasn’t come in the form of judicial rulings. She’s never been a judge, the first such nominee in over 40 years (the last one being William Rehnquist). So I don’t necessarily hold that against her. On the other hand, President Bush’s first SCOTUS nominee, Harriet Myers, didn’t have that judicial experience either.
Which means Каган is a blank slate, ready to do Оба́ма‘s bidding: browbeating Justice Kennedy into voting for her side of the aisle. I’ll bet her constituents are ecstatic. I hope the GOP fights this nomination!

F.I.I.F.

Filed under: | Axis of Donks | SCOTUS and The Law

While I strain to go back to sleep, here’s what’s on the wires:

SIGN “O” THE TIMES: Yet another signal that the Оба́ма Honeymoon is over….

THOMAS SKIPPED SOO SPEECH: Wait till you read why. And I don’t blame him. Oh, and did I mention he b***h-slaps the guy who insulted him and the Court?

2 SCOTUS VACANCIES THIS SPRING? Don’t get fired up just yet....

ACORN Fraks The USA Again

Filed under: | Axis of Donks | SCOTUS and The Law

Nothing like shopping around for a judge who will rule in their favor, as ACORN apparently did. The ruling that Конгрессa’s cutoff of Federal funding to ACORN is unconstitutional puts them right back in business. The only thing Конгресс can do now is to bar ALL such funding to similar groups, but I highly doubt they have the fortitude to do such a thing. After all, it is controlled by the Demo☭rats.
I really, really hope that Andrew Breitbart makes good on his threat to release ACORN videos right before the 2010 elections. In the meantime, git yer ACORN Hunting Permits right here!

YO Joe!

Filed under: | SCOTUS and The Law | The 48th State

Looks like Sheriff Joe’s won another round in the US District Court, where his opponents attempted to expand a specific lawsuit to a class action. Hispanic advocacy groups have been complaining for a long time that the Sheriff of Maricopa County has been racially profiling during saturation patrols…which, BTW, has resulted in the arrests of over 31,000 Illegals since he began doing this.
What gets me is, these activists will never understand that Sheriff Joe’s job is to enforce the law. I’ll bet if he speaks it en Español, they’d get it. However, this is the USA and he shouldn’t have to speak it in any other language BUT ENGLISH!

SCOTUS Rules on Sotomayor Case

Filed under: | SCOTUS and The Law

Just coming across the wire now…5-4 in favor of the Firefighters in Ricci v. DeStefano. Of course this is right down ideological lines; it’s pretty obvious who voted what…and I’ll bet the five Justices were probably thinking “You gotta be kidding!”.
This will also put Judge Sonia Sotomayor on the hot seat, because it was her ruling which was struck down. Let’s see…that makes it 4 of 6 rulings which have gone to the Supreme Court, and have been overturned. She’s gonna get grilled Big Time during her hearings.
I don’t give a s**t what the el cubos think and have stated elsewhere…this judge is RACIST.

SCOTUS To Intervene in Chrysler BK?

Filed under: | Business | SCOTUS and The Law

I believe it was Sherlock Holmes who said “Mr. Watson, the game is afoot!” I beileve this is apropos for this development, as three Indiana pension and construction funds filed a request with Associate Justice Ruth Bader Ginsburg to halt the sale of the majority of Chrysler’s assets to Fiat SpA.
Is Justice Ginsburg a red flag in this matter? Not necessarily. Each Supreme Court Justice is assigned a certain area of the country to handle whether the court should hear the case. Besides, two branches of the Federal Government are already involved; might as well throw SCOTUS into the mix, to see if it can straighten things out.
Also keep in mind that FDR conflicted with SCOTUS in the early years of his administration.

Feelings…Wo-wo-wo Feelings…

Filed under: | Axis of Donks | SCOTUS and The Law

Dang it! I thought I had an mp3 of Morris Albert’s “Feelings” hit from the 1970s in my iTunes library…but I don’t. Oh well. So much for playing that soppy song in this post. But I digress.
Anyway, Президент Оба́ма will announce that he has chosen Federal Appeals Court Judge Sonia Sotomayor as his nominee for Associate Justice of the Supreme Court, to succeed retiring Associate Justice David Souter. All along, he’s hinted that he wants people on the Court to take people’s feelings into consideration when ruling on cases, over and above what they are supposed to bed doing…and that is to INTERPRET THE LAW AS IT IS WRITTEN. I won’t even go into the concept of taking into account foreign law as precedent, which I’m sure he’d love to have this Court run.
The Президент may have a fight on his hands, as I believe there may be a few Democrat Senators who will have an issue with this, and subsequently side with the GOP to allow a filibuster to proceed.
As it is, if Оба́ма gets Sotomayor past the Senate, her seating won’t change the overall ideological makeup of SCOTUS. That is why I will continue to pray for the good health of not only the liberal members of the Court, but especially Associate Justices Thomas, Scalia, Alito, and Kennedy, as well as Chief Justice Roberts, as long as Оба́ма remains in office.

BREAKING: Justice David Souter to Retire

Filed under: | SCOTUS and The Law

Word from NPR that Associate Justice David Souter is going to step down from the Supreme Court, giving Президент Оба́ма his first opportunity to start packing the Court the way he wants it. Granted, the guy is from the liberal side, but the Президент‘s choice will tell us yet again where he wants to take the country.
Again, I ask all of you to continue to pray for the continued good health of the conservative members of the Court for the next four years and then some.

Naked City Story

Filed under: | SCOTUS and The Law

When I was a kid, one program which I was not allowed to watch was Naked City. Back then I thought it was about a bunch of people running around naked. As it turned out, it was a Cop show, a predecessor of Law & Order.
Here’s a narrative in the spirit of that old show:

My partner and I were working plainclothes duty as we drove toward a suspected drug supply house in Queens. A cry for help changed our direction as I made a right turn toward the scream.
We were shocked to see a naked woman in her late 20’s running along the street and screaming for help. As we jumped out of the car to approach her, she ran toward us and grabbed my partner in a bear hug.
“Are you the police?” she cried hysterically.
“Yes, ma’am” my partner replied, taking her by the shoulders and holding her at arms length as both of us tried to adjust to the incongruity of the situation.
“What happened?” I asked, wishing I had a jacket or something to cover her while we inquired.
“My husband!” she screamed. “He’s killing him! Please help him!”

Ho Magnet?

Filed under: | SCOTUS and The Law

From what I understand, San Francisco has a history of wildness in the Barbary Coast, dating back to the days of the California Gold Rush. Now, it seems, there is a ballot proposal to recreate that environment by decriminalizing prostitution:

“It will allow workers to organize for our rights and for our safety,” said Patricia West, 22, who said she has been selling sex for about a year by placing ads on the Internet. She moved to San Francisco in May from Texas to work on Proposition K.
Even in tolerant San Francisco—where the sadomasochism fair draws thousands of tourists and a pornographic video company is housed in a former armory—the measure faces an uphill battle, with much of the political establishment opposing it.

Um…would you like Preparation H® or Vaseline® with that?

OJ Jury: Let’s Go To The Tape

Filed under: | SCOTUS and The Law

Now word has come out that the nine-woman, three-man jury for OJ’s robbery and kidnapping trial did not trust any of the witnesses which were called, and as a result, they went to some other evidence…namely, the tape recorded by the host of the debacle. Evidence like that doesn’t lie.
Seven of the jurors agreed to hold a Press Conference to share their views on the case, and also to get the reporters off their backs. They also found that the police didn’t have an airtight case against the former football player; hence, they went to the tape. Now why doesn’t that surprise me? Still, OJ’s in the slammer now. We’ll find out in two months for just how long.

Justice Catches OJ!

Filed under: | SCOTUS and The Law

FINALLY. Drudge couldn’t have said it any better.
OJ Simpson was found guilty of all charges in Las Vegas, he’s not done just yet Now his lawyers will scream charges of RACISM because there were no blacks on his nine-women, three-men jury. So will his supporters.
And here’s another uncanny tidbit from the case: the verdict came exactly 13 years to the day after OJ was acquitted of murder charges in LA. Cue for the Twilight Zone please. Still, as a robbery/kidnapping convict who also happens to be a sports celebrity, OJ should expect a “relatively pleasant” time in the Nevada State Pen…and whether this brings the saga with the Goldman family to a close is yet to be seen, since it’s obvious he’s NEVER going to see the money awarded to him for the civil case.
See Ya, OJ! Just don’t convert to Islam while you’re in there OK?
