Constitutional Shield

As bad as his alleged actions were in Minneapolis, Senator Larry Craig has a shield named the United States Constitution; specifically, Article I, Section 6, which clearly states:

The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States. They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

Since he was arrested at 1200 hours Central Time on June 11, and he cast a vote on the Floor of the Senate at 1755 Hours Eastern Time that day, he was in transit to conduct Official Business, and therefore, the arrest and Guilty plea will have to be thrown out. This is no different than any diplomat’s official immunity from prosecution under International Law. This story broke when it did to block public scrutiny of Norman Hsu’s activities benefiting the junior Senator from New York State.
